Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and CrewCheckr ("we," "us," or "our") and govern your access to and use of our websites, applications, SMS messaging programs, and related services (the "Service"). By creating an account, opting in, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of a company, you represent that you are authorized to bind that company to these Terms. You are responsible for the accuracy of the information you provide, for keeping it up to date, and for maintaining the confidentiality and security of your account credentials and all activity under your account.
The Service
CrewCheckr delivers daily work checklists and related reminders by text message (SMS) and through our website and applications, on behalf of employers. We may add, change, or remove features at any time, and we may set limits on use of the Service.
Free trials and billing
We may offer free trials and paid plans. Unless stated otherwise, fees are billed in advance, are non-refundable except where required by law, and exclude taxes, which you are responsible for. Paid subscriptions renew automatically for the same term unless you cancel before the renewal date. We may change pricing on a prospective basis with reasonable notice. You can cancel at any time; cancellation takes effect at the end of the current billing period.
SMS messaging terms
By providing your mobile number and opting in, you consent to receive recurring automated text messages from CrewCheckr and your employer. Consent is not a condition of employment or of purchasing any goods or services. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe at any time, or HELP for help. Carriers are not liable for delayed or undelivered messages. You represent that you are the subscriber or authorized user of the number you provide.
Acceptable use
You agree to use the Service only for lawful purposes and in compliance with these Terms. You will not misuse, interfere with, or disrupt the Service; attempt to gain unauthorized access to it or related systems; reverse engineer or copy the Service except as permitted by law; upload unlawful, infringing, or harmful content; or use the Service to send messages to people who have not consented. You are responsible for obtaining all necessary consents from individuals whose information you submit.
Customer data and content
You retain ownership of the information and content you submit to the Service ("Customer Data"). You grant us a limited license to host, process, and use Customer Data as needed to provide and improve the Service and as described in our Privacy Policy. You are responsible for the legality and accuracy of Customer Data and for having the rights and consents needed to provide it to us.
Intellectual property
The Service, including its software, design, and content (excluding Customer Data), is owned by CrewCheckr or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. All rights not expressly granted are reserved.
Third-party services
The Service may rely on or link to third-party services (such as messaging carriers and authentication providers). We are not responsible for third-party services, and your use of them may be subject to their own terms and policies.
Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that messages will be delivered without delay or error.
Limitation of liability
To the maximum extent permitted by law, CrewCheckr and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid us in the twelve months before the claim or one hundred U.S. dollars.
Indemnification
You agree to indemnify and hold harmless CrewCheckr and its affiliates from any claims, damages, liabilities, and expenses arising out of your use of the Service, your Customer Data, or your violation of these Terms or applicable law.
Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or other users. Upon termination, your right to use the Service ends, and we may delete Customer Data in accordance with our Privacy Policy.
Governing law and disputes
These Terms are governed by the laws of the United States and the State in which CrewCheckr is established, without regard to conflict-of-laws rules. You agree that disputes will be resolved in the courts located there, except where applicable law provides otherwise.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
